§ 10-26. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Dangerous/vicious animal means:

    (1)

    Any domestic animal which, according to the records of any law enforcement agency within the county, has inflicted injury on a human being without provocation on public or private property;

    (2)

    Any domestic animal which, according to the records of any law enforcement agency within the county, has injured or killed a domestic animal without provocation while off the owner's property;

    (3)

    Any dog, not owned by a governmental or law enforcement unit, used primarily to guard public or private commercial property; or

    (4)

    Any domestic animal approaching an individual in such a way as to place that individual in reasonable fear of unprovoked injury or attack whether it occurs upon streets, sidewalks and public grounds or private property.
